INTRODUCTION TO EKHAYA RISK SERVICES

Ekhaya Risk Services (ERS) is an actuarial and risk consulting business operating in South Africa. We specialize in actuarial assessment of damages and related claims such as:

  • Loss of Support assessments: e.g RAF and related claims.
  • Loss of income assessments: e.g RAF and related.
  • Compensation claims; e.g wrongful arrest or personal injury.
  • Medical negligence claims.
  • Work based compensation claims e.g Asbestosis.
  • Maintenance claims against deceased estates.
  • Employee Benefits Valuations (Pension Funds).

RAF SPECIFIC ASSESSMENTS

These typically comprise one or more of the following categories: Loss of Support

  • Estimation of past and future loss of income for eligible dependents.
  • For child dependents; support is estimated to end of calendar year child turns age

18 or age 21 (but to age 24 for those still in tertiary institution).

  • For eligible adult dependents e.g Common law or customarily married spouse,

support is estimated to retirement age of the deceased.

  • Allowance is made for incomes of the deceased and dependent spouse

(household income).

  • Key input is information from Assessor’s report and RAF claim forms.

Loss of Income

  • Involves estimation of claimant’s income assuming the accident did not occur

(Pre-accident income).

  • Estimation of claimant’s income now that accident has occurred (Post-accident

income).

  • Difference constitutes the loss of income and is calculated as at a calculation date

(not far off the expected settlement date).

  • Key input is income progression (pre and post-accident) as interpreted from

Industrial Psychologists reports. In addition, joint minutes may be applied in case

  • f wide opinions between plaintiff IP report and that of defendant’s.

OTHER CLAIMS

Cost of medical and other interventions

  • The IP reports detail frequency and cost per incident of any recommended

interventions e.g doctor visits, future surgery; physiotherapy, domestic assistance, equipment aids, wheel chairs etc.

  • Each line of intervention is the actuarially costed and disclosed to client. This

includes frequency of change of equipment such as wheel chairs etc.

  • Or party paying undertakes to meet costs of intervention in future.

Damages, personal injury, wrongful arrests etc.

  • Great reliance is made on Case law in South Africa.
  • Large number of cases published in Quantum Yearbook and reference is made to

such cases when recommending quantum of claims to be made. Claims include

  • riginal amounts and the current value of amounts.
  • We re-confirm estimation of current values using our internal economic models.

2020 Fees Excl. VAT on RAF Actuarial Assessments

  • R6750 per assessment (based on initial instructions) for clients willing to settle

the fee within 3 months of the actuarial report date: or

  • Recalculation reports charged at reduced rates of R1050
  • Our pricing is for full comprehensive reports on the cases.
  • Alternative pricing may be agreed by the parties on other terms and conditions

Fees Applicable for all Other Claims:

  • The fee is negotiated between ERS and agreed with the Practice prior to

assessment and will have regard to the precise nature of assessment. NOTE: Damages & Assistive Devices Claims Where Damages Assessment is carried out in addition to Loss of Income, an additional fee of R2500 would apply, and for Assistive Devices, an additional fee ranging from R1500 - R3000 depending on costings would be levied on the extra task. REQUIREMENTS FOR LOSS OF EARNINGS CALCULATIONS: 1. Case number and High court handling the case. 2. Medico – legal Report on claimant (prepared by qualified and approved Medico – legal specialist. 3. Individual details required include the following: For the claimant:

  • Name.
  • Date of birth.
  • Gender (male or female).
  • Copy of ID (will have all the above information).

  • Details/description of earnings (pre-accident).
  • PLEASE INCLUDE COPIES OF PAY SLIPS PRIOR TO ACCIDENT WHERE POSSIBLE.
  • Details of earnings (post – accident).
  • PLEASE INCLUDE COPIES OF PAY SLIPS POST ACCIDENT (IF AVAILABLE).

Other reports:

  • Occupational therapist reports (where available).
  • Specialist reports from Doctors (Orthopaedics, Neurologist and Clinical

Psychologists). REQUIREMENTS FOR LOSS OF SUPPORT CALCULATIONS: The typical data requirements are as follows: 1. Case number and High court handling the case. 2. Detailed assessor’s report on quantums and merits if you have already commissioned one. 3. RAF claim form (fully completed, where relevant). The typical information is as follows: For the deceased:

  • Copy of ID.
  • Copy of death certificate/ (confirmation of date of death and death itself).
  • Date of accident.
  • Confirmation of employment at death: e.g. Employer’s certificate /letter.
  • Confirmation of earnings at the time of death: preferably copies of recent pay

slips prior to death. Confirmation of marital status/living partnership or customary union (if applicable).

Where applicable, the following details for the spouse/partner:

  • Copy of ID (to obtain the DOB).
  • Confirmation of employment at time of deceased death; Employer’s

certificate/letter.

  • Confirmation of earnings at the time of deceased’s death, preferably copies of pay

slips prior to deceased death. For all minor dependents:

  • Copy of ID’s or clinic cards or confirmation of dates of births.
  • Copies of recent school reports.
  • Copies of college/university transcripts for those in higher institutions.

Other information:

  • ITC enquiry reports If needed to verify other information above.
  • Accident reports from SAPS.
  • Affidavits from family member and/or other thirds parties confirming marriage,

employment or dependency.

  • PLEASE DO NOT INCLUDE SASSA RECEIPTS AS THESE ARE NON-DEDUCTIBLE FOR

LOS CASES

  • Confirmation of any major dependents (e.g. mothers or fathers):
  • If true, then copy of ID or other date of birth confirmations.
  • Details of any letters of administration (if applicable) and related liquidation

assets.
