  • Any individual could be debtor

EFFECTS:

  • Creditors viewed law

as providing few payments, and discharging many debtors

  • Repealed in 1843

  • Schedules: Detailed lists filed by the debtor along with the petition

showing the debtor's assets, liabilities, and other financial information.

  • Trustee: The representative of the bankruptcy estate who exercises

statutory powers, principally for the benefit of the unsecured creditors, under the general supervision of the court/The trustee's responsibilities include reviewing the debtor's petition and schedules and bringing actions against creditors or the debtor to recover property of the bankruptcy estate.
