Objective

• Justice in the Risk Society focuses on the tension between

risks and rights. It consists of two subprojects which each will focus on areas where new regulations and/or legislations have been developed in order to control risk, and where the new regulations may challenge fundamental rights. Through the two empirical examples this project will explore to what extent the effort to control risk has led to new legislation or new practices, and further on how the control of risk are balanced with citizens’ fundamental rights.

• Subproject 1 will examine new legislative measures and

practices that facilitate co-operation and exchange of information between the Norwegian police and the police in

• ther Schengen countries.
• Subproject 2 will analyze the discourse of justice in recent

crime and security policy initiatives in Norway, by analyzing how recent legal initiatives, influenced by risk and/or security thinking, have dealt with the issue of justice.

Approach, method, disciplines

• Approach: The project will explore to what extent the

effort to control risk are balanced with citizens’ fundamental rights.

• Methods:

– Traditional legal method analysing legal texts and

• fficial documents (Subproject 1)

– Text analysis, discourse analysis (Subproject 2)

• Disciplines: Law, criminology, sociology of law

Perceived results and benefits

• Even though the two subprojects are empirical
• riented and focus on specific sectors of society,

Justice in the Risk Society will generate general knowledge on the intersection between risks and rights.

• The project will also generate knowledge of risk

management that will be of value for the society as a hole.
